Terms of Service

1. Eligibility

The Service is intended for users who are at least 13 years old (or the minimum digital-consent age in your jurisdiction). If you are under that age, please do not use the Service. By using the Service you represent that you meet this requirement.

2. Acceptable use

You agree that you will not:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Attempt to gain unauthorised access to the Service, its systems, or other users' accounts.
• Interfere with the Service through denial-of-service attacks, scraping at abusive rates, or by introducing malware.
• Reverse engineer, decompile, or attempt to extract source code except as expressly permitted by law.
• Click on advertisements served on the Site for the purpose of generating fraudulent revenue.
• Reproduce, copy, sell, or commercially exploit any portion of the Service without our prior written permission.

3. Intellectual property

The Site design, layout, brand assets, original artwork (including the cover and player backdrops generated for this catalog), curated text, and selection of games are the property of PixelGamesHub or our licensors, protected by copyright, trademark, and other laws. Self-hosted classic HTML5 games included in the catalog are made available under their respective open-source licences (for example MIT, GPL); see public/games/LICENSES.md in our repository or the in-page credits for each game. Embedded third-party games remain the property of their respective owners and are subject to the providers' own terms.

4. Embedded third-party games

Many games are loaded from third-party providers via iframes. PixelGamesHub does not control the conduct of those providers and is not responsible for their content, advertisements, or data practices. Your use of an embedded game is subject to the provider's terms of service and privacy policy in addition to these Terms.

5. Advertising

The Service is supported by advertising including Google AdSense and offerings from our distribution partners. By using the Service you acknowledge and accept that ads will be shown alongside or before games. Advertisements are served by third parties whose privacy and data-handling practices are described in our Privacy Policy.

6. Submissions

If you submit a game, content, or feedback (for example through the For Studios form), you grant PixelGamesHub a worldwide, non-exclusive, royalty-free licence to use, reproduce, publish, and display that submission as needed to operate the Service. You represent that you have the rights necessary to grant this licence and that the submission does not infringe any third-party rights.

7. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. PixelGamesHub does not warrant that the Service will be free from errors or that any defect will be corrected.

8. Limitation of liability

To the maximum extent permitted by law, PixelGamesHub and its operators will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses arising out of or related to your use of the Service. In jurisdictions that do not allow such limitations, our liability is limited to the smallest amount permitted by applicable law.

9. Indemnification

You agree to defend, indemnify, and hold harmless PixelGamesHub from any claim, loss, or demand, including reasonable legal fees, made by any third party arising out of your breach of these Terms, your misuse of the Service, or your violation of applicable law or third-party rights.

10. DMCA / IP complaints

We respect intellectual property rights. If you believe that content available through the Service infringes your rights, send a notice to szperone@gmail.com including: (a) identification of the copyrighted work; (b) the URL of the allegedly infringing content; (c) your contact information; (d) a statement of good-faith belief that use is not authorised; (e) a statement under penalty of perjury that the information is accurate; and (f) your physical or electronic signature. We will respond promptly and may remove or disable access to content as appropriate.

11. Termination

We may suspend or terminate access to the Service, in whole or in part, at any time and without notice if we believe that use of the Service violates these Terms or harms the Service or its users. Sections of these Terms that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law) will survive.

12. Changes

We may revise these Terms from time to time. The "Last updated" date reflects the most recent change. If a revision is material we will provide additional notice (for example a banner on the Site). Your continued use of the Service after the changes take effect constitutes your acceptance.

13. Governing law

These Terms are governed by the laws applicable at the operator's principal place of business, without regard to its conflict-of-laws principles. Disputes that cannot be resolved informally will be brought before the competent courts in that jurisdiction, except where mandatory consumer-protection laws of your residence provide otherwise.
